Disappointment this morning as the Supreme Court denied an appeal by Little Sisters bookstore in Vancouver for financial assistance in its ongoing battle with Canada Customs. This case, and its predecessors seems to have been going on most of my gay life (at least since I became aware of such things in the early 1980s) and most of the cases have resulted indecision in Little Sisters favour. Canada Customs has been found to have discriminated against the store because it specialises in gay and lesbian material and has been ordered to amend its policies and procedures. But Little Sisters complained the harassment and discrimination have continued and sought financial assistance, under the federal Court Challenges program, to continue its fight against Canada Customs, in the public interest.
The Supreme Court’s 7-2 decision is disappointing but, in light of the Conservative government’s evisceration of the Court Challenges program, has likely been made largely irrelevant by the passage of times of indirectly related events.
